TERMS & CONDITIONS OF USE

Welcome to the South Australian Academy of Music Website. This website is owned and operated by the South Australian Academy of Music ("SAAOM").These Terms set forth the terms and conditions under which you may use our website and services as offered by us.  This website offers visitors information regarding our services and team and also allows you to register as a member, book services online, and purchase products via our online shop. By using the SAAOM Website, you signify that you have read, understand and agree to be bound by these Terms of Use (this “Agreement”).

Right to Change and Modify Terms

SAAOM, its related entities (including parent companies, sister companies and subsidiaries), affiliates, officers, agents, and other partners and employees reserves the right, at its sole discretion, to change, modify, add, or delete portions of these Terms of Use and any other Policies at any time without further notice. If this is done, we will post the changes to these Terms of Use on this page. Your continued use of the Web Site after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, please do not use or access the Web Site. It is your responsibility to regularly review these Terms of Use. By using the Web Site, you represent and warrant that you agree to  abide by all of the terms and conditions of this Agreement. You confirm you have the authority to bind yourself /your company to the terms and conditions set forth herein.

User Conduct

In order to use our website and receive our services, you must be at least 18 years of age, or have the approval of your parent or legal guardian.  To register as a member you must be 18 years of age, or have the online registration completed by your parent or legal guardian.  If you are under 18 your parent or legal guardian must provide their details on your account, during the online registration process.  You agree that no materials of any kind submitted through your account will violate or infringe upon the rights of any third party, including copyright, trademark, privacy or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material. You further agree not to harvest or collect email addresses or other contact information of users from the Web Site by electronic or other means. Additionally, you agree not to use automated scripts to collect information from the Web Site or for any other purpose. You further agree that you may not use the Web Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Web Site. In addition, you agree not to use the Web Site to:

  • upload, post, email, transmit or otherwise make available any content that we deem to be harmful, threatening, abusive, harassing, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable, or intimidate or harass another Web Site user.

  • impersonate any person or entity, or falsely state or otherwise misrepresent yourself or your affiliation with any person or entity.

  • upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

  • use or attempt to use another’s account, service or system without authorisation from SAAOM, or create a false identity on the Web Site.

Key Commercial Terms

When buying an item, you agree that you: (i) are responsible for reading the full item listing before making a commitment to buy it; (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out process.

The prices we charge for using our services/buying our products are listed on the website.  We reserve the right to change our prices at any time, and to correct pricing errors that may inadvertently occur.  Additional information about pricing and sales tax is available on the payments page.

Return and Refund Policy

Due to the nature of products sold, we do not refund products only for change of mind. If a product can be shown to be damaged at time of purchase we will exchange if possible or refund.  All products are checked prior to leaving our shop. All books are sold brand new and in good condition and cannot be returned.

Retention of Right to Change Offering

SAAOM may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services.  We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Promotional Emails and Content

If you choose to subscribe to our SAAOM's website or register as a member, you agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages).  If you don't want to receive such promotional materials or notices, please notify us at music@saaom.com.au or adjust your account preferences in your member login.

Proprietary Rights in Content on SAAOM

All content on the Web Site, including but not limited to design, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, text, graphics, other files, and their selection and arrangement and all Intellectual Property related thereto (the “Content”), are the proprietary property of SAAOM, its affiliates, or its licensors. All rights reserved. The Content may not be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without SAAOM or the licensor's prior written permission. You may download or print a copy of any portion of the Content solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. You may not republish Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation. Any other use of the Content is strictly prohibited.

All trademarks, logos, trade dress and service marks on the Web Site are either trademarks or registered trademarks of SAAOM, its affiliates, or its licensor's and may not be copied, imitated, or used, in whole or in part, without the prior written permission of SAAOM.

You recognise and agree that by uploading any content (including but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works( through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content.  You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

Right to Suspend or Cancel User Account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations.  You may discontinue use and request to cancel your account and/or services at any time.  Where a service has been booked in advance (e.g. full term of lessons) the account will be cancelled only upon the expiration of the respective period for which you have already made payment/agreed to.

Trademarks

The SAAOM name, logo and all related product and service names, design marks and slogans are trademarks, service marks, registered trademarks or registered service marks of ASAAOM and may not be used in any manner without the prior written consent of SAAOM. All other trademarks and service marks are the property of their respective owners.

Accuracy of Information

Product and service specifications and other information not describing SAAOM's services have either been provided by the Vendors or collected from publicly available sources. While SAAOM makes every effort to ensure that the information on this Web Site is accurate, we make no representations or warranties as to the accuracy or reliability of any information provided on this Web Site regarding Vendors and should be independently confirmed by you. SAAOM makes no warranties or representations whatsoever with regard to any product provided or offered by any Vendor, and you acknowledge that any reliance on representations and warranties provided by any Vendor shall be at your own risk.

No Endorsement

Mention of third-party products or services, including the use of trademarks or links to the web sites of Vendors, is for informational purposes only and constitutes neither an endorsement nor a recommendation of those Vendors or the related products or services. In addition, such use of trademarks or links to the web sites of Vendors is not intended to imply, directly or indirectly, that those Vendors endorse or have any affiliation with SAAOM.

Website Communities

SAAOM's website and mobile booking application allows users to join SAAOM's online community.  All users who join SAAOM's community have a public profile that is publicly visible to site visitors, and their public activity, including posts or comments, will be visible to other visitors of the website.  Where the community requires users to be registered members, visibility will be limited to only those members who have registered with the SAAOM.  Users are welcome to opt-out and exit the community, and upon doing so, the users profile will not be publicly visible. If users opt-out they will not be able to use the community features.


User Disputes

You are solely responsible for your interactions with other SAAOM users. You agree that SAAOM shall have no responsibility with regard to any interactions you may have with other users.

Disclaimers

SAAOM is not responsible for any incorrect or inaccurate Content posted on the Web Site, whether caused by users of the Web Site, or by any of the equipment or programming associated with or utilised in connection with the Web Site. SAAOM is not responsible for the conduct, whether online or offline, of any user of the Web Site. The Web Site may be temporarily unavailable from time to time for maintenance or other reasons. SAAOM assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, user or user communications. SAAOM is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, or failure of email on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to users or to any other person’s computer related to or resulting from participating or downloading materials in connection with the Web Site. Indemnity

These Terms of Use constitute the entire agreement between you and SAAOM regarding the use of the Web Site, superseding any prior agreements between you and SAAOM relating to your use of the Web Site. The failure of SAAOM to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. SAAOM may contain links to other sites on the internet which are owned and operated by Vendors or other third parties. You acknowledge that SAAOM is not responsible for the availability of, or the content located on or through, any external web site.

Permitted Use of Content

You may not copy, modify, redistribute, or publish any Content of the Web Site without the express written permission of SAAOM or the owners of such Content if other than SAAOM, unless such copying, modification, redistribution or publication is expressly permitted by the Web Site or through an integrated web site function (such as the emailing of user search results).

Governing Law and Venue

If there is any dispute about or involving the Web Site, you agree that the dispute will be governed by the laws of South Australia without regard to its conflict of law provisions.

If you choose to access our site or other services, you agree to do so subject to the internal laws of South Australia. You are in the best position to know whether your use of our site or other services may be prohibited or restricted by local laws in your location, and therefore are responsible for compliance with any such laws.

What Information Do We Collect and How Is It Used?

SAAOM collects the following information regarding visitors to our website: the pages that you view, the links you click and other actions taken in the website. We also collect certain standard information that your browser sends to every website you visit such as your IP address (browser type, language, access times) and referring website addresses. SAAOM collects and logs this information for statistical purposes.

At times, we ask you to voluntarily supply personal information, such as your name, email address, website registrations, preferred means of communication and survey information, for purposes such as accessing our online webcasts or participating in an online survey, or registering an account with us.

Other than as stated above, no attempt is made to identify users or their browsing activities except, in the event of an investigation, where a law enforcement agency may exercise a warrant to inspect logs, or where SAAOM believes it is required to collect and produce relevant electronic documentation to fulfill its obligations to third parties, including statutory organisations under local law.

SAAOM endeavours to use and disclose your personal information only in limited circumstances. SAAOM will do so if it is necessary to protect any copyright or intellectual property in the material in the website, or if it is necessary to enforce the SAAOM website Terms and Conditions of Use.

Security

SAAOM takes all reasonable security measures to protect personal information from loss, unauthorised access, destruction, misuse, modification or disclosure. As far as permissible under law, SAAOM accepts no responsibility for the unauthorised access of personal information held by SAAOM.

Updating this Policy

The content of this Policy may be updated from time to time, so we suggest that you return to the website on a regular basis and carefully read the information provided.

Resumes

We take all reasonable steps to ensure that only the SAAOM Hiring Managers gain access to your resume, and only for the purpose of considering you for career opportunities with SAAOM. We also endeavour to ensure that those who gain access to your resume comply with the relevant privacy laws. We do not suggest that you forward resumes to email addresses you may find on this website unless you have been requested to do so in writing by an SAAOM Hiring Manager.  SAAOM cannot guarantee protection of resumes forwarded in instances where they have not been specifically requested from you.
